CA Files Writ Before Gujarat High Court For Being Unable to Pay Advance Tax Due to Portal Glitches

Over the last few months, many taxpayers and CA professionals have raised issues about the continuous technical glitches on the Income Tax e-filing portal. Some of the taxpayers also complained that the income tax portal became inaccessible just minutes before the due date of paying advance tax, i.e., September 15, 2025.

One of the Chartered Accountants has taken this matter of portal glitches before the Gujarat High Court. CA Mehul Shah, along with CAAS and others, filed a writ petition to prove that the income tax portal had continuous glitches.

As per Shah, the portal was shut three minutes before midnight on the last day, while he was about to enter the OTP for advance tax payment. Due to this glitch, he was unable to pay taxes on time, which resulted in interest penalties under Section 234C of the Income Tax Act.

He has filed a writ petition under the special civil application no. 2825. The petition mentions the constitutional rights and provisions under the Income-tax Act, 1961, due to the non-functional portal.

Vipasha Mehul Shah, the petitioner, complained that they tried paying the advance tax of Rs 2,50,000 on September 15, 2025. However, since the ITR filing due date was extended to September 16, 2025, the portal started facing technical issues. Shah tried to log in to the income tax portal from 11:30 PM onwards, but the portal was continuously unstable and login attempts failed. And even after logging in, there was no option to pay the tax. At 11:50 PM, the portal went down for maintenance.

This experience shows how taxpayers and CAs are stressed because of the problems with the income tax portal. The non-payment of advance tax will result in a penalty even though the reason for the failure to meet the deadline is genuine.
